Revaluation – Are you getting it wrong?

Hope you are exceptionally well today.

Been overwhelmed by two things recently — firstly, due to the huge support and instructions continuing from you – thank you, as I absolutely love my vocation and being able to help; and secondly i’ve been overwhelmed at my lack of pace, having made a somewhat comical return to veterans football on Friday mornings at 6.30am?! (currently out injured!)

Segwaying perfectly, where we risk leaving our clients seriously underwhelmed, is by not understanding revaluation in public sector pension schemes (aka final salary; aka defined benefit)

Put simply, if the scheme that your client may have been a member of, or may be a member in the future is with the public sector, then you are probably under settling your claim by an average of 34.69% and it could be more or less depending on the timeframes involved.

I successfully argue in joint statements how revaluation over and above CPI included in the Ogden 8th edition multipliers should be included in defined benefit public sector schemes and why.

Now if you are anything like most solicitors you may think – ‘bugger, I’ve just done one’ or words to that effect – however, do not fear – you can run it by me and the team and instruct me as your agent under Smith Graham v Lord Chancellor or Cross Practice Direction 47; 5.22 (6) – this means similar to how you might use an agent for medical pagination or costs, you can use me and my team to put calculations in your schedule whilst claiming your time/hourly rate.
